Coronavirus Trucking Understanding the Emergency Declaration by the FMCSA

On 18 th  March, the FMCSA released an Emergency Declaration keeping in terms with the national emergency due to the serious spread of COVID-19 (Coronavirus). As per the Emergency Declaration, commercial drivers  who are engaged in providing ‘direct assistance’  have been exempt from 42 CFR parts 390-399 (what qualifies as direct assistance is listed out further below). This exemption has been made to ensure the delivery and transportation of emergency services possible all across the country. It must be noted here in this regard that the Emergency Declaration will be applicable with immediate effect and will remain in effect till either the emergency situation is terminated as defined in 49 CFR § 390.5 or until 12 th  April 11:59 P.M. The Federal Motor Carrier Safety Administration   or FMCSA have implemented the new ELD rules to regulate the drive time as well as the resting periods of the commercial drivers on the roads of the USA. The aim of this implementation is to reduce the rate of road accidents caused due to fatigue and distraction of the truck drivers. Before ELD was implemented; FMCSA noticed that most of the truck accidents were caused because of the fatigue of the truck drivers because they do not follow any fixed Hours of Service or HOS. Though there was an electronic onboard recorder or EOBR, it was not mandatory to have the device installed on the trucks to track the HOS of the drivers.
